While a majority of the Supreme Court strongly urged the legislature and the governor to adopt such a rule, after determining that no such rule currently exists in New Jersey, the Court held that the convictions of the two defendants, Dionte Byrd and Freddie Dean, Jr. should be reversed and the matter remanded for a new trial.
