The epidemiology chapter mentions Rule 703 only in a footnote.[1] Rule 703 appears to be the red-headed stepchild of the Federal Rules, and it is often ignored and omitted from so-called Daubert briefs.[2] Perhaps part of the problem is that Rule 703 (“Bases of an Expert”) is one of the mostly poorly drafted rules in the Federal Rules of Evidence: “An expert may base an opinion on facts or data in the case that the expert has been made aware of or personally observed.
