  While we voted on whether to rehear this case en banc, the Court denied Beaty's petition for certiorari challenging the State's decision to substitute the drugs.Lest anyone think that this is purely a dispute between Republican and Democrat appointees, I will note that Judge Tallman was appointed by President Clinton, as were two of the three judges in the panel that affirmed the District Court's denial of a stay.  Judge Tallman says that there should be qualified immunity for doing so because running a prison is a tough place and it makes sense for a guard to put a prisoner into solitary confinement on the very same day the prisoner makes a complaint against him because that way the guard and prisoner won't have any additional interactions.Fortunately (in my view), district court Judge Rayes, sitting by designation from Arizona, agrees with Judge Kozinski.
