Another little IP gem from online subscription service LexisNexis Butterworths is the Chancery Division for England and Wales decision on Monday of Mr Justice Patten in Boehringer Ingelheim Ltd v Vetplus Ltd, so far unreported on BAILII.This was an application by Boehringer for ex parte interim injunctive relief to stop Vetplus publishing an advertisement and a press release in various journals relating to one of its products. Well done, LexisNexis Butterworths, for unearthing Knight v Beyond Properties Pty Ltd and others [2007] EWHC 1251 (Ch), an obscure ruling by Mr Justice David Richards in the Chancery Division yesterday on a neat little passing-off point.Knight, a British citizen who lived in Australia, published three books in the UK between 1991 and 1996; each had the word 'Mythbusters' in its title.
