Apple, with Judge Gonzalez Rogers having denied an Epic motion for a temporary restraining order (TRO) over the removal of Fortnite from the App Store but having granted it so Epic would, for the time being, retain access to Apple's developer tools with a view to the iOS and Mac versions of Unreal Engine.In the Google case, however, I was still waiting for lawyers to appear on the search company's behalf (for a reminder, Epic is represented by Cravath and Apple by Gibson Dunn). Bornstein asked him whether he'd be surprised to know that the exact number was zero...Those Cravath lawyers have been doing a phenomenal job for Epic, but undoubtedly the highlight of the trial was the roughly ten minutes during which Judge YGR took Tim Cook to task. [read post]

In September I mentioned that the volume of Qualcomm's share buybacks is simply irreconcilable with last year's claim (by Qualcomm's lead counsel in the Apple case in the Southern District of California, Cravath's Evan Chesler) that the house was "on fire," and in that post I quoted an analyst who complained about an unusual degree of discrepancy between what Qualcomm tells judges and what it tells financial analysts.
