In the Kenya case, the Pre-Trial Chamber refused to authorize an investigation into events that occurred after the Prosecutor submitted his request for authorization to the Pre-Trial Chamber: Article 53(l)(a) of the Statute, by referring to “a crime [which] has been or is being committed”, makes clear that the authorization to investigate may only cover those crimes that have occurred up until the time of the filing of the Prosecutor’s Request.
