Evaluating the applicant’s assertion of a violation of the duty to state reasons, the Court recited Articles 75 CTMR and Article 50(2)(h) of Regulation 2868/95, which prescribe the duty to state reason in relation to the OHIM’s decisions, and stated that the requisite aims to allow the parties to know the justification for an act or measure, enabling them to protect their rights, and to allow the EU judges to review its legality.
