The Watkins ruling was vacated by a larger panel of the 9th Circuit, which instead ruled in Watkins' favor using a non-constitutional theory of estoppel, reasoning that since the Army had allowed Watkins to re-enlist several times even though his homosexuality was known to them, it was precluded from rejecting his re-enlistment.
