I do, however, think that Judge Brown has the better argument, and one that finds support in serious scholarly treatment of the issue by administrative-law scholars like Thomas Merrill (here with Kathryn Tongue Watts in the Harvard Law Review and here in the Administrative Law Review) and Richard Pierce (here).
