On March 29, 2012, after an administrative hearing requested by Virginia Tech, Administrative Law Judge (“ALJ”) Canellos issued a ruling vacating the fine and stating that Virginia Tech did not violate the timely warning requirements and that any failure to follow its procedures concerning timely warnings was a “technical deviation” of its policy and did not warrant a fine.
