The authors' central argument is that, in most instances, when someone tries to trademark a foreign term that is generic in the home language (or merely descriptive in the home language), the term should be translated from the foreign language into the domestic language in determining distinctiveness for purposes of protectability, regardless of whether consumers in the domestic country where protection is sought understand the term's meaning.
