In his judgment (Ali & Anor v Channel 5 Broadcast Ltd [2018] EWHC 298 (Ch)) Arnold J accepted that the Defendant’s programme did contribute to a debate of public interest, but considered that the inclusion of the Claimants’ private information went beyond what was justified for that purpose.
