It’s a terribly unfair example of special interest legislation and judicial activism for the benefit of the medical device manufacturers, but at least there’s one tiny exception to those dismal cases: if a person injured by a PMA medical device can prove that the manufacturer was negligent in a way that also violated FDA regulations, then they can recover compensation.
