He doesn't seem to like much of anything about what counsel for appellants have done.The overwhelming majority of the opinion is about the quality of the briefing, and the arguments therein, rather than on the actual merits of the case. [read post]

Back in 2016, Judge O'Scannlain authored this opinion, and Judge Fisher's dissent summarized the relevant holding as follows:"When a sitting juror is alleged to have continuously texted a judge friend about the trial and relayed the judge’s information to the jury, the majority concludes the trial court need not investigate further – and the jury verdict would not violate due process. Judge Ikuta authored the majority opinion, and Judge Christen dissented.Although the plaintiff here wanted to secretly record communications involving public issues (e.g., public officials, BLM officers, etc.), the holding seems to me to apply equally to secretly recording even routine conversations with your neighbors, coworkers, etc. [read post]
