If, as Marilyn suggests, the infringing behaviour was exaggerated or entirely fabricated (which I acknowledge is not unheard of in Family Court cases) – it is highly unlikely that the prosecution will be able to satisfactorily prove the “substantial adverse effect on [the alleged victim’s] usual day-to-day activities” that is part of the offence in “alarm and distress” cases.
