Consistent with the court’s opinion in Tiffany v Ebay, which placed the burden of policing the mark on Tiffany even though Tiffany argued that Ebay was in a better position to police their mark, the 7th Circuit affirmed that trademark owners must retain decision making authority over quality issues as a prerequisite to policing the mark in order to preserve their rights.
