The 4th Circuit Court of Appeals ruled that because al-Marri is not a member of any enemy nation's army, never took up arms with al-Qaeda or the Taliban against the United States, never engaged in direct hostilities with the United States, and was never even present on a battlefield, he cannot be locked up in military detention, but must be tried in a civilian court for his alleged crimes.
