On 30th June 2010 the Supreme Court missed an opportunity to extend the human rights of British soldiers serving abroad when six of the nine justices in the case of Private Jason Smith held that unless they are on a United Kingdom military base, British troops on active service overseas are not within the jurisdiction of the UK for the purposes of the European Convention on Human Rights 1950 art. 1 and so were not subject to the protection of the Human Rights Act 1998.
