Just like in foreclosure actions where banks and lenders are required to produce original Notes and Mortgages in order to prove they have the right to foreclose, original credit agreements and accurate payment histories must be produced in order for banks to obtain judgments against delinquent credit card holders.   There’s also $3 billion that’s supposed to be devoted to the refinancing of underwater but current mortgages, but this fund will only apply to mortgages owned by one of the five banks involved in the settlement… Bank of America, JPMorgan Chase, Wells Fargo, Citibank, and Ally Bank/GMAC… and then, only to those current on their mortgage payments.
