It is what divided the House of Lords in Stack v Dowden [2007] UKHL 17 in part (or so it seemed) but it was never entirely clear whether the majority of the House in that case was explicitly accepting an imputation, perhaps partly (unfairly) because previous judges had occasionally elided them when they should have known better.
