Steve Vladeck headed such conversation off, though, by noting three problems with such a prosecution: first, the section of the Logan Act prohibiting correspondence with with any foreign government “without authority of the United States” probably doesn’t apply to senators; second, the First and Fifth Amendments probably protect the senators’ letter; and finally, no one has ever been successfully prosecuted under the Logan Act.
