Having resisted so well to the inventive step attacks and held its ground against the arguments on undue burden to produce anything within the claims, it was ultimately felled by Deputy Judge Michael Tappin QC in Saint-Gobain v 3M [2022] EWHC 1018 back in May because there was no dependent claim with a narrower range to save the independent claim whose range was too broad.
