Among other things, Prop 209 makes it harder for premier public schools in the state (like UC Berkeley) to compete with premier private universities in the state and nation (like Stanford and the Ivies), because private universities, even those located in California, are not governed by Proposition 209 and thus can (and do) use race as a factor in admissions.So, as I wrote in the LA Times right after Fisher came down, Proposition 209’s days could very well be numbered.
