Nearly a dozen states have passed laws prohibiting non-compete agreements below certain income thresholds or subject to other limitations, but Section 181.988 has Minnesota join California, North Dakota, and Oklahoma as one of the few jurisdictions with an outright ban on non-compete restrictions. In the meantime, employers operating within the Eighth Circuit—comprising Arkansas, Iowa, Minnesota, Missouri, Nebraska, North Dakota and South Dakota—are encouraged to evaluate their non-discrimination policies with this potential change to the federal law in mind, to the extent they have not already done so to comply with state or local laws.
