Last week, Chinese media reported on the ruling.According to Counterpoint Research, OPPO shipped well 33.6 million smartphones during the last quarter, making it number four in the global market in its own right--though if you throw in the 32.5 million units sold by vivo and the volumes of other subsidiaries of the BBK Electronics group (such as OnePlus), we're actually talking about the world's largest smartphone maker (well ahead of Samsung and Apple). The fact that Amazon uses large parts of Android without a license from Google doesn't mean that the same would work for Samsung or HTC; and companies focusing on the Chinese market are in a different position than those who generate most of their sales in the U.S. and Europe (even in China there's profound concern over Google's heavy-handedness with respect to Android). I don't know whether the Epic Games Store, if it already existed on iOS, would have accepted my app (we'd have to build a Windows version and submit it to them to find out), but considering that similarly-themed games are available on Steam (a pretty meaningful point of reference), the Samsung Galaxy Store, the Microsoft Store etc., I'd be reasonably optimistic. Initially, the U.S. trade agency with quasi-judicial powers was practically unreceptive to FRAND defenses, but then came the Obama Administration's 2013 veto--on public-interest grounds--of an import ban Samsung had won against Apple.I don't have good news for those who want the ITC to be able to carry out its duties in an efficient and predictable manner.
