Not only because Congress has made it harder for federal courts to do this (state courts get the benefit of the doubt when interpreting the Constitution, even if incorrectly), but because the state conviction has already gone through the appellate process in New York and the Appellate Division and maybe even the New York Court of Appeals has already upheld the conviction.
