In the end, everyone in the courtroom seem to have concluded that he does (with Trial Counsel expressing some reservations on this point), but that he did not have the power to order the Convening Authority to grant the relief requested (i.e., to pay for expert assistance pre-trial).Apparently, in two prior instances, the Convening Authority had refused to allow the defense to make an ex parte requests for such assistance.
