Yesterday, October 19, 2011, the Hawaii Supreme Court issued a unanimous opinion authored by Justice McKenna in In re Attorney's Fees of David Bettencourt, SCAP No. 30616, holding that an administrative judge's decision to summarily reduce attorneys' fees incurred by court-appointed counsel was inappropriate. That's right.Chief Justice Cantil-Sakauye writes the majority opinion, but also authors a short concurrence as well -- one that's joined by the other conservative justices -- that says that X and Y don't make doctrinal sense; i.e., that they're inconsistent. [read post]
