As we learned in law school, some Justices believed in total incorporation (all eight Amendments are fully incorporated through the Due Process Clause of the Fourteenth Amendment), others in selective incorporation (those interests in the Bill of Rights that are fundamental to the Anglo-American system of justice are incorporated), and others were fundamental fairness advocates (only those rights that are fundamental to a fair trial are incorporated).
