Anyway, If I learn more about the argument, I’ll add an update. 2) As my co-blogger Stewart Baker noted earlier, Judge Collyer authored a recently-declassified opinion for the Foreign Intelligence Surveillance Court disagreeing with Judge Leon’s view for the DC District Court that the telephony metadata program violates the Fourth Amendment.
