Prosecutors at the ICC have determined that they lack jurisdiction to investigate crimes allegedly committed in Gaza, reasoning that Palestine does not constitute a “state” for purposes of Article 12 of the Rome Statute and hence cannot confer jurisdiction on the ICC (leaving only the option of a UN Security Council referral, which of course has not happened in this instance).
