The EBA concluded that the technical boards of appeal as defined in A 21(3)(a) and (b) EPC 1973 have to decide on appeals from a decision of an ED refusing a request under R 89 EPC 1973 for correction of the decision to grant ([6]). [7] From this reasoning of the EBA the present board draws the conclusion that a positive or negative decision of an ED on a correction of the grant decision under R 140 concerns the grant of a patent in examination proceedings.
