We ran into related issues during the pre-Obergefell litigation on marriage equality, when the United States Attorney General and some State Attorneys General declined to defend the constitutionality of marriage and marriage-related laws that were discriminatory, and other parties (generally representatives of legislative factions and state or local officials) stepped in to do so, with fairly limited success.
