Abbott Laboratories Inc., 444 F.3d 383 that the plaintiff there could bypass the "vaccine court" and litigate in the usual court for damages because the suit was against the makers of thimerosal, which, not being a vaccine, didn't fall under the protection of the legislation. [read post]
