Keep in mind, for each statement, that Eramo must (A) show it’s false, (B) show it tends to injures her reputation, (C) show it’s a factual assertion, and not a statement of opinion, (D) show reasonable readers would see it as being about her (the so-called “of and concerning” requirement, and (E) show, by clear and convincing evidence, that defendants knew it was likely false (my shorthand for the knowledge-or-reckless-disregard standard).
