Lord Justice Rimer (who gave the leading opinion, Lord Justice Thorpe assenting) gave some (very cold) comfort to tenants by asserting that if they were forced to go to Court to compel a landlord to protect their deposit then they should be able to recover their legal costs. [read post]

Rimer LJ cast serious doubt as to whether the rule is appropriate in libel cases: “If the single meaning rule does achieve a fair balance in defamation law between the parties’ competing interests, that would appear to be the result of luck rather than judgment; and how the measure of such claimed fairness might be assessed may anyway be questionable. Its name is Ajinomoto Sweeteners Europe SAS v Asda Stores Ltd [2010] EWCA Civ 609 and it's a ruling of the Court of Appeal for England and Wales (Sedley LJ, Rimer LJ and Sir Scott Baker) last Wednesday, 2 June.Asda (the British embodiment of Walmart) sold its own health food products, some of which were labelled with appealing little phrases like "No hidden nasties" and "No artificial colours or flavours and no aspartame". That decision was upheld on first appeal, and the appellant appealed to the Court of Appeal.The Decision: Lord Justice Wall and Lord Justice Rimer allowed the appeal, and declared that the parties hold the severed joint tenancy as tenants in common in equal shares. [read post]
