Let me be clear: Neither is true. 1) As a Massachusetts murder defense attorney, I am not an advocate of using the insanity defense, for the primary reason that it almost never succeeds. 2) I believe that in this particular case, the evidence submitted into the record warranted a finding of a straight “Guilty” finding. That’s unfortunate, for two reasons: 1) Many times, the evidence clearly calls for it; and 2) If such a verdict is returned, it doesn’t mean the defendant didn’t commit the act, and it doesn’t mean the defendant walks away free. [read post]
