As of 2021, 19 states[11] and the District of Columbia conform to federal NOL provisions.[12] By conforming to the federal code, states mimic: 1) the annual loss deduction cap (losses carried forward may not reduce current tax liability by more than 80 percent); 2) the unlimited number of years to which losses can be carried forward; and 3) the prohibition against carrying losses back to offset previous years’ tax liabilities.
