Any argument that due process rights are breached by failure to protect the defendant’s position should the claimant be unsuccessful at trial should surely be countered by the claimant’s Article 6 right of access to court which is itself protected by Article 9(3) of the Aarhus Convention and by the case law of the ECtHR under Article 6 (Airey v Ireland Series A No 32 (1979) 2 EHRR 305; Golder  v United Kingdom Series A No 18 (1975) 1 EHRR 524).
