As I've explained at length previously, that's not a problem for the CCAs, because their judges are quite clearly "inferior" Executive Branch officers (if for no other reason than because they are subject to the appellate supervision of the Court of Appeals for the Armed Forces, which is "located for administrative purposes only in the Department of Defense").
