Not sure whether it is fatalism, pessimism or perhaps legal realism that has me thinking the direct DJ/late notice/prejudice bill is going to pass the NYS Legislature in the next 9 days, but maybe now is a good time to review what liability insurers will need to prove or establish to sustain late notice disclaimers in about 189 days or so.
