Defences – justification (truth) There is not much to report in relation to this defence: the burden of proof is – and is likely to remain – on the defendant, despite calls from some campaigners for it to shift (The ECtHR has held that requiring defendants to prove truth is not incompatible with Article 10: see McVicar v UK (2002) 35 EHRR 22; Steel v UK [2005] EMLR 314).
