Although I couldn't find an Eleventh Circuit case that did exactly that, various Eleventh Circuit cases quote the "happenstance" language, and the principle pretty clearly derives from the SCOTUS opinion in Munsingwear itself.Does the Department of Justice decision to seek neither a stay pending appeal nor expedited review amount to the sort of deliberate action that makes Munsingwear mootness unavailable?
