  The citation to Wells was clearly wrong in that the plaintiffs in that case had, in fact, relied upon studies that were nominally statistically significant, and so the Wells court could not have held that statistical significance was unnecessary.[1] The two other cases cited by the Supreme Court, however, were both about “differential diagnosis,” and had nothing to do with statistical significance.
