While it looks like the State gave notice to Cherokee Nation and Blackfeet Tribe with all the information on the record, and it’s also good the State noticed local Michigan tribes (State is required to contact a tribe in the county where the child is located under 712B.9(3)), the original notice to *all* of the tribes should be in the record. Strangely enough, the Michigan Supreme Court appears to have reached the same conclusion about its own practices in a 2015 decision, and yet the State of Michigan still argued in this case that the practice was not unconstitutional.Finally, this case highlights the importance and potential injustice of the Supreme Court's byzantine retroactivity doctrine.
