With respect to proportionality and costs, Lord Neuberger and Lord Dyson considered the issue of recoverability of additional liabilities in the context of the test for assessment of costs laid down in Home Office v Lownds [2002] EWCA Civ 365 (which permitted a party to recover disproportionate base costs so long as they were necessarily incurred).
