In the end, the Court of Appeal of the Hague ruled that for the purposes of article 2(7) BC, being eligible for copyright protection would be sufficient.Surprisingly, the Dutch Supreme Court now questions altogether if the earlier adopted principle of reciprocity can be justified through article 2(7) BC.The Supreme Court was brought to this doubt due to the RAAP-case by the CJEU (case C-265/19).
