If the p’s theory of confusion makes nonsense out of factors like bridging the gap/consumer confusion, or if IIC can’t logically fit into the multifactor test because it doesn’t survive 5 or 6 factors, maybe that’s an indication that the cause of action is the problem because there were reasons the factors got in the test in the first place.
