Neither do I.Whether the particular record here is clear enough to so find is a matter of dispute between the majority opinion (written by Judge Reinhardt) and the partial dissent (written by Judge Rymer), and I think that both positions in this regard are reasonable.But I'm nonetheelss left with a firm and definite belief -- rightly or wrongly -- that the plaintiff here will say whatever needs to be said in order to obtain damages and fees.Do some social benefits result from ADA… [read post]

Plaintiffs want you to say: "Hey, we're just doing what everyone does -- express our opinions about candidates -- and, yeah, we spend a little money to do so, but so does everyone, so the statute's unconstitutionally vague, because how were we to know that the typical run-of-the-mill stuff we're doing violated the statute? So I found it unusual that Justice Baker wanted to express the point in, of all opinions, this one.Usually the informal give-and-take amongst justices on a panel obviates at least the perceived necessity for a concurrence like this one, at least in your run-of-the-mill type of dispute.Not so here.
