 And not granting res judicata effect does indeed diminish the incentive for plaintiffs to adopt these alternative (superior) approaches.But the Court of Appeal nonetheless thinks that these counterarguments as a whole don't justify doing an injustice and depriving plaintiffs of their day in court.And I get that.
